Terms and Conditions of Use — Betamigos

These Terms and Conditions of Use (the "Terms") govern access to and use of the Betamigos platform (the "Service"), available at https://betamigos.io and operated by FRIZZO TECH SOLUTIONS INOVA SIMPLES (I.S.), registered under CNPJ No. 67.804.372/0001-41 ("Betamigos", "we", "us" or "our").

By creating an account, accessing or using the Service in any way, you (the "User" or "you") represent that you have read, understood and fully agree to these Terms and to our Privacy Policy. If you do not agree to any part of these Terms, do not use the Service.

1. What Betamigos is — and is not

1.1. Betamigos is an information and analytics software tool for sports bettors. Its features include, among others: tracking line movement and sending alerts when odds move or present value; and a bet tracker that computes metrics such as Closing Line Value (CLV) and profit/loss (P&L) and maintains a personal record of wallets and balances entered by the User.

1.2. Betamigos is NOT a bookmaker, sportsbook, betting exchange, broker, payment institution, financial institution or gambling operator. The Service does not accept, intermediate, process or settle bets, and does not hold, receive or move any betting funds or money of the User.

1.3. The "wallets", "balances", "deposits" and "withdrawals" displayed in the Service are solely a personal bookkeeping record kept by the User for tracking and statistical purposes. These figures are entered by the User, do not represent money held by Betamigos, and do not constitute a payment account, deposit, or any custody of funds. Real money remains, in all cases, owned by and held with the bookmakers and financial institutions chosen by the User.

1.4. The odds, lines, charts, alerts, value indicators (EV), stake suggestions and other data displayed are provided for informational and statistical purposes only and do not, under any circumstances, constitute a recommendation, advice, or instruction to place any bet. Nothing in the Service should be construed as financial, investment or betting advice.

2. Eligibility and legality

2.1. Minimum age. The Service is intended solely for persons 18 years of age or older (or the age of majority applicable in your jurisdiction, if higher). By using the Service, you represent and warrant that you meet this requirement.

2.2. Local legality. Sports betting is regulated differently in each country, state and locality, and is prohibited in some places. It is the User's sole responsibility to verify and comply with all laws applicable in their place of residence and access before using the Service or placing any bet with third parties. Betamigos is not responsible for use of the Service in jurisdictions where betting, or the use of related tools, is restricted or illegal.

2.3. Accurate registration. You agree to provide true, complete and current information at registration (including, where applicable, name, country, identification document and contact details) and to keep it updated. You are solely responsible for the confidentiality of your credentials and for all activity carried out under your account.

3. No guarantee of profit; risk of the activity

3.1. Betting involves risk of loss. You acknowledge and accept that all sports betting involves financial risk and that losses — including the total loss of amounts wagered — are possible and common.

3.2. We do not guarantee winnings. Betamigos does not guarantee, promise or warrant any profit, gain, return, positive result, win, "value bet", "sure bet" or performance of any kind arising from use of the Service. Indicators such as positive EV, CLV, line movement or stake suggestions are statistical estimates and do not predict or guarantee the outcome of any event or bet.

3.3. Past performance does not guarantee future results. Any statistics, history, examples or results shown in the Service or in our materials do not constitute a promise or guarantee of future results.

3.4. The decisions are yours. Any and all decisions to bet, in what amount, with which bookmaker and under which conditions are exclusively yours. You fully assume the risk and consequences of your decisions.

4. Third-party data, accuracy and availability

4.1. Data source. The odds, lines, results and other data displayed are obtained from third-party providers and may be delayed, incomplete, out of date or incorrect. Betamigos depends on the availability and accuracy of those providers and does not guarantee the correctness, completeness, timeliness or currency of any information.

4.2. Errors and voids. Odds and opportunities may contain palpable errors, may be changed or voided by bookmakers, and may no longer be available by the time you attempt to use them. Always verify odds, lines and conditions directly with the bookmaker before betting.

4.3. Service availability. The Service is provided "AS IS" and "AS AVAILABLE". Coverage of sports, leagues, bookmakers and markets may vary, decrease or be interrupted at any time. We do not guarantee that the Service will be uninterrupted, timely, secure, error-free or that defects will be corrected.

4.4. Calculations and indicators. CLV, EV, P&L, balances, exposure and stake suggestions are computed from third-party data and from information entered by the User. Input errors, stale odds or missing data may produce inaccurate results. These calculations are informational and should always be verified by the User.

5. User responsibilities

5.1. Relationship with bookmakers. Every bet is placed by you, directly, with the bookmaker you choose. Betamigos has no relationship, control or responsibility over the bets placed, payments, withdrawals, voids, account limitations or any actions taken by bookmakers or financial institutions. You are solely responsible for reading and complying with the terms, rules and limits of those bookmakers.

5.2. Accuracy of your records. You are responsible for the truth and accuracy of the data you enter into the tracker (bets, odds, stakes, results, deposits, withdrawals, etc.). Betamigos merely organizes and computes on what you provide.

5.3. Acceptable use. You agree not to: (a) use the Service for unlawful purposes; (b) attempt to access areas, data or accounts of others without authorization; (c) reverse engineer, automatically scrape, resell, redistribute or commercially exploit the data or the Service without our express authorization; (d) overload, interfere with or compromise the integrity or performance of the Service; or (e) infringe the rights of third parties or these Terms.

6. Subscriptions, payments and refunds

6.1. Plans. The Service may be offered in free and paid plans with different feature tiers. The features and current prices of each plan are presented within the Service and may change upon reasonable prior notice.

6.2. Payment. Payments may be processed by third-party payment providers (including in cryptocurrency). By purchasing a plan, you agree to the terms of the relevant payment processor. Betamigos does not store sensitive payment data.

6.3. Prepaid renewable model. Paid subscriptions operate, where applicable, on a prepaid, per-cycle basis: access to plan features is valid for the contracted period and ends at the close of the cycle unless renewed/paid again.

6.4. Refunds and right of withdrawal. Under art. 49 of the Brazilian Consumer Protection Code (Código de Defesa do Consumidor — Law No. 8.078/1990), you may withdraw from the purchase within seven (7) days from the purchase date, with a full refund of the amounts paid. Outside the withdrawal period, and unless otherwise required by law, amounts paid are non-refundable, particularly once you have begun using the plan's features. Refunds, when due, are processed through the same payment method used at purchase.

7. Third-party services and integrations

7.1. The Service may integrate with, or depend on, third-party services such as odds-data providers, payment processors, authentication providers (e.g., social login) and notification channels (e.g., messaging apps). Betamigos does not control and is not responsible for the availability, content, policies, accuracy or practices of those third parties. Use of such services is subject to each provider's own terms and policies.

8. Intellectual property

8.1. The Service, including its software, code, design, trademarks, layout, text, graphics and other elements, is owned by Betamigos or its licensors and is protected by intellectual property laws. These Terms do not transfer any ownership right to you. You are granted only a limited, personal, revocable, non-transferable and non-exclusive license to use the Service in accordance with these Terms.

9. Disclaimer of warranties

9.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the Service and all of its content are provided "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, whether express or implied. Betamigos disclaims all warranties, including, without limitation, those of merchantability, fitness for a particular purpose, title, non-infringement, accuracy of data, and uninterrupted or error-free operation.

9.2. Betamigos does not warrant that the Service will meet your requirements or expectations, achieve any intended result, be compatible with other software, or that defects will be corrected. Any material obtained through the Service is used at your own risk.

10. Limitation of liability

10.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BETAMIGOS, ITS OWNERS, DIRECTORS, EMPLOYEES, SUPPLIERS AND LICENSORS SHALL IN NO EVENT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING OUT OF OR RELATED TO THE USE OF, OR INABILITY TO USE, THE SERVICE, including, without limitation:

10.2. In particular, and reiterating Section 1, Betamigos is not liable for any bet placed or not placed, won or lost, nor for any decision made based on information, alerts, calculations or suggestions displayed in the Service. Any loss arising from betting is the User's exclusive responsibility.

10.3. Liability cap. Should, despite the foregoing, any liability be attributed to Betamigos, the total aggregate liability shall be limited to the greater of (a) the total amount you actually paid to Betamigos for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) USD 100.00 (one hundred US dollars) or its equivalent in local currency.

10.4. The limitations in this Section apply regardless of the legal theory invoked and even if Betamigos has been advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law (including, where applicable, consumer rights).

11. Indemnification

11.1. You agree to defend, indemnify and hold harmless Betamigos and its related parties from and against any claims, demands, losses, liabilities, damages, costs and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any law or of third-party rights, including bookmakers' terms; or (d) the bets and financial decisions you make.

12. Responsible gambling

12.1. Betting should be a form of entertainment, not a source of income nor a solution to financial difficulties. Only bet what you can afford to lose.

12.2. If you or someone you know shows signs of problem or compulsive gambling, seek professional help. [Insert, per jurisdiction, applicable support resources, e.g., helplines and responsible-gambling bodies.]

13. Suspension and termination

13.1. We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, in the event of a breach of these Terms, suspected fraud or misuse, legal requirement, or discontinuation of the Service. You may close your account at any time. Termination does not, by itself, give rise to a right to a refund, except as provided in Section 6 and applicable law.

14. Changes to the Terms and the Service

14.1. We may amend these Terms at any time. The updated version will be posted within the Service with a new effective date. Material changes may be communicated by reasonable means. Continued use of the Service after the changes take effect constitutes acceptance of them. We may also modify, suspend or discontinue features at any time.

15. Governing law and venue

15.1. These Terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil, including the Consumer Protection Code (Law No. 8.078/1990) and the General Personal Data Protection Law (Law No. 13.709/2018 — LGPD).

15.2. The User's domicile is the elected venue to settle any disputes arising out of these Terms, without prejudice to any other forum granted to the consumer by law.

16. General provisions

16.1. Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.2. No waiver. Tolerance of any breach of any provision does not constitute a waiver of the right to enforce it.

16.3. Entire agreement. These Terms, together with the Privacy Policy and any plan-specific terms, constitute the entire agreement between you and Betamigos regarding the subject matter hereof.

16.4. Assignment. You may not assign these Terms without our consent. We may assign them to successors or in the context of a corporate reorganization.
